General Terms of the Promotion.

1. This promotion is offered (i) for K-Series by Lightspeed Commerce Inc, 700 St-Antoine E, Suite 300, Montreal, QC H2Y 1A6, Canada, and (ii) for O-Series by Kounta Pty Ltd (ABN: 38160947384), Level 1/17 Eveleigh Street, Chippendale, NSW 2008, Australia (each “Lightspeed” as the case may be).
2. It only applies to new Lightspeed customers located in Australia who subscribe to an annual Lightspeed Restaurant K-Series or Lightspeed Restaurant O-Series plan (“POS Subscription”) and Lightspeed Payments between November 1, 2024 and December 13, 2024 (“Promotion Period”), subject to execution of the applicable Agreement(s) and/or Order Form before December 13, 2023 (“Eligible Customers”). Eligibility for the promotion shall be at Lightspeed’s sole discretion.
3. Subject to these terms, conditions and exclusions, Eligible Customers can benefit from a 50% discount on hardware purchased through Lightspeed during the Promotion Period (the “Promotion”).
4. The Promotion is subject to (i) Eligible Customers remaining on their POS Subscription for at least 12 months, and (ii) Eligible Customers taking Lightspeed Payments and, subject to approval of its Merchant Application by Lightspeed, processing a minimum of $1,000 within 30 days of such approval. The offer may not be available for certain industries that cannot be serviced by Lightspeed Payments. Lightspeed reserves the right, at its sole discretion, to determine the eligible industries.
5. Hardware will only be shipped upon receipt of the first payment on the POS Subscription. Apple products are excluded from the Promotion. All Hardware is subject to availability and all imagery is intended for illustrative purposes.
6. If the Eligible Customer terminates its POS Subscription within 12 months of signing its Order Form, Lightspeed reserves the right to invoice the Eligible Customer for the amount equal to the discount on hardware purchased under this Promotion.
7. The Promotion (i) is not available to customers who sign up for the $40/month Basic plan for O-series, (ii) does not apply to any other hardware, hardware bundles, software or services purchased or subscribed to by an Eligible Customer; including but not limited to: Marketing & Loyalty, Ordering, Bumpit and Delivery (iii) cannot be combined with any other Lightspeed offers or discounts; (iv) and is not transferable or exchangeable and cannot be taken as cash Fees for additional products and services may apply as identified on the Order Form.
8. To the extent permitted by law, Lightspeed, its Affiliates, such party’s agents, directors, officers, employees, representatives, consultants and advisors shall not be liable for any claims, damages, injuries, costs and expenses suffered, sustained or incurred (including but not limited to indirect or consequential) as a result of, arising out of, or in any way connected with this Promotion.
9. Lightspeed may extend, change, suspend or terminate this Promotion or modify its terms at any time.
